Consumer Health Data Privacy Policy

This policy applies to "consumer health data" about residents of Washington (under the My Health My Data Act), Nevada and Connecticut, and to anyone else whose state gives similar protections. It supplements our Privacy Policy.
Consumer health data we collect
- The fact that you are interested in refractive lens exchange or other vision correction surgery, and that you requested a consultation.
- What you currently wear to see (glasses, contacts, readers or a combination).
- Your age range, which may suggest age-related vision changes.
- Your name, ZIP code, phone number, email address and IP address, when linked to the items above.
- What you tell our patient care team (including our AI assistant) by phone or text about your vision, eye history and interest in treatment, and recordings or transcripts of those calls.
Where we get it
Directly from you, through the consultation request form on this site. We don't buy consumer health data from anyone.
Why we collect and use it
- To provide the service you asked for: answering your questions and connecting you with a participating eye care practice for a consultation when you are ready.
- To contact you about your request, as you agreed.
- To keep records of your consent and opt-out choices, and to comply with the law.
- To protect the site against fraud and spam.
Who we share it with
- The one participating eye care practice that serves your ZIP code, named on the form before you agree. Participating practices may pay us for the referral. Current participating practices: K2 Vision; Laser Eye Center of Silicon Valley; Cutarelli Vision.
- Our service providers (processors): Netlify (website hosting and form storage), our customer relationship management provider (lead management), our AI calling and texting provider, and Resend (email delivery).
We have no affiliates that receive consumer health data. You can ask us for a list of the specific third parties we have shared your data with.
Your consent
We collect consumer health data only with your consent, and we share it with a participating practice only with your consent, which you give when you submit the consultation form. You can withdraw your consent at any time by emailing us.
Your rights
You have the right to:
- Confirm whether we collect, share or sell your consumer health data, and see it.
- Get a list of all third parties and affiliates we have shared or sold it to, with their contact information.
- Withdraw your consent.
- Have your consumer health data deleted, including from our service providers.
- Appeal if we refuse your request.
To use these rights, email info@refractivelensexchange.com or call (877) 745-8876. We will respond within 45 days, and may extend that once by 45 more days if needed, telling you why. To appeal a decision, reply to it with "Appeal" in the subject line. We will respond to your appeal within 45 days. If you are not satisfied, you can contact your state attorney general (in Washington: atg.wa.gov/file-complaint).
