These Terms of Use govern your use of RefractiveLensExchange.com (the "Site"), operated by RefractiveLensExchange.com LLC, an Arizona limited liability company ("we," "us"). By using the Site, you agree to these Terms. If you don't agree, please don't use the Site.
Educational information, not medical advice
Everything on the Site is general information about refractive lens exchange and related procedures. It is not medical advice, diagnosis or treatment, and it does not create a doctor-patient relationship with us or anyone else. Only an eye surgeon who examines you can tell you whether a procedure is right for you, what it will cost and what results you can expect. Results, risks and recovery vary from person to person. If you have a medical emergency, call 911.
Our matching service
When you request a consultation, we pass your request to a participating eye care practice in your area. We are not a medical practice and we don't employ, supervise or control any practice or surgeon. Practices are independent businesses responsible for their own services, licensing, pricing and care. Listing or referring a practice is not an endorsement or a guarantee of any outcome. Participating practices may pay us for referrals. "Complimentary consultation" means the practice has agreed not to charge for the initial consultation; any testing, treatment or later visits are between you and the practice.
Cost information
Costs shown on the Site are typical U.S. ranges for general comparison. They are not quotes and may not reflect prices in your area. Your surgeon's practice will give you its own price.
Calls and texts
If you check the consent box on our form, you agree that we and the participating practice in your area may contact you at the number you gave, including by autodialed calls, texts and artificial or AI-generated voice, about your inquiry. Consent is not a condition of any purchase. Message and data rates may apply. Reply STOP to any text to opt out, or see our Privacy Policy for other ways to withdraw consent.
Your responsibilities
You agree to give accurate information, to submit only your own contact details or details you are authorized to submit, and to be at least 18. You agree not to misuse the Site, including by submitting false or automated requests, trying to break its security or interfering with its operation.
Our content
The Site's text, design, graphics and logos belong to us or our licensors and are protected by copyright and trademark law. You may view and print pages for your personal, non-commercial use. Don't copy, republish or sell our content without written permission.
Links to other sites
The Site may link to websites we don't control. We aren't responsible for their content or privacy practices.
Disclaimer of warranties
THE SITE AND ITS CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE." WE DON'T WARRANT THE SERVICES OF ANY PRACTICE OR SURGEON.
Limitation of liability
TO THE FULLEST EXTENT THE LAW ALLOWS, WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR ANY MEDICAL TREATMENT OR OUTCOME PROVIDED BY ANY PRACTICE OR SURGEON. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SITE IS LIMITED TO $100. Some states don't allow these limits, so they may not apply to you.
Indemnity
You agree to defend and hold us harmless from claims arising from your misuse of the Site or your violation of these Terms.
Governing law and disputes
These Terms are governed by the laws of the State of Arizona, without regard to its conflict-of-law rules. Any dispute relating to the Site or these Terms will be resolved exclusively in the state or federal courts located in Arizona, and you and we consent to the jurisdiction of those courts.
Changes
We may update these Terms. Changes take effect when posted here, and the date at the top will change. Continuing to use the Site after a change means you accept it.
